‘MYDEMOCRACY WATCH’<br />
Sempena Pemilihan Parti KeADILan Rakyat (KeADILan) yang akan berlangsung di antara 17 September hingga 21 November 2010, yang melibatkan 218 Bahagian dan kira-kira 400 ribu ahli yang layak menggundi, kami berasa bertanggungjawab untuk membantu KeADILan untuk memastikan Demokrasi sebenar diamalkan semasa pemilihan tersebut.</p>
<p>Kami mengucapkan tahniah kepada pimpinan KeADILan di atas kesungguhan melaksanakan Demokrasi di dalam parti terutama sekali dengan membuat pindaan berani dan bersejarah dengan memberi hak kepada setiap ahli untuk menentukan kepimpinan masa depan parti. Memandangkan harapan rakyat yang ditunjukkan pada 8 Mac 2008 yang lalu mahukan Demokrasi yang benar tertegak di negara ini adalah menjadi cabaran kepada Keadilan untuk membuktikan bahawa amalan demokrasi yang akan ditunjukkan semasa pemilihan tersebut adalah satu contoh Demokrasi yang baik.</p>
<p>Sejarah pemilihan dan pilihanraya lalu memberi pengajaran bahawa Demokrasi bukan saya mengenai peluang untuk bertanding malah ia juga berkehendakkan prinsip-prinsip urus tadbir (governance) Demokrasi juga diamalkan.</p>
<p>Atas dasar itu, MYDEMOCRACY WATCH akan bertindak sebagai badan pemantau terhadap urus tadbir pemilihan terutama yang melibatkan amalan penyalahgunaan kuasa, sumber kerajaan dan amalan-amalan lain yang tidak demokratik seperti kronisme, rasuah dan nepotisme. Kami berjanji akan membantu dan membela mereka-mereka yang berasa hak demokrasi mereka dinafikan semasa pemilihan tersebut tanpa menyebelahi mana-mana kelompok berkepentingan. Kami yakin inisiatif sebegini  akan membantu kita memastikan Demokrasi tertegak di mana-mana proses demokrasi di Negara.</p>

Malah gesaan YB Tony Pua untuk menghapuskan kuota bumiputera untuk pembelian hartanah mewah bernilai RM500 ribu ke atas perlu diberikan penilaian yang sewajarnya. Pendekatan bermusim membangkitkan isu ini perlu dihentikan kerana ianya sehingga hari ini gagal membantu mereka yang menjadi mangsa dasar yang berniat baik tetapi gagal memberi keadilan ke pada semua warga Malaysia terutama mereka yang perlu dibantu.</span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt;"><span style="font-family: Times New Roman; font-size: small;">Warga Balik Pulau, Melayu dan juga bukan Melayu contohnya, hari ini menjadi penonton pembangunan hartanah mewah yang rata-rata melangkaui kemampuan majoriti penduduk setempat. Semenjak penghujung 1990an banyak projek-projek perumahan diluluskan dengan rancak sekali. Rata-rata harga jualan di antara RM300-900 ribu yang diluar kemampuan penduduk setempat. Kawalan hanya terhadap pelan sahaja. Bagaimana dengan harga? Adakah kita perlu pasrah dengan pasaran apabila tidak ada dasar dan mekanisme yang mengawal? </span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt;"><span style="font-family: Times New Roman; font-size: small;">Isunya kenapa dengan kewujudan 30% dan kuota yang ditetapkan atas nama ‘Kontrak Sosial’ berpuluh-puluh tahun orang Melayu masih bergelut dengan hak pemunyaan hartanah (property ownership)? Ramai yang masih merempat di kampong sendiri. Definisi perundangan menjadikan mereka ‘setinggan’ kerana tinggal di atas tanah orang lain. Di mana 30%? Di mana Kuota? Apakah dasar sekarang mampu menjamin niat anak orang muda yang mahu memilki rumah yang selesa buat keluarga tersayang? </span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt;"><span style="font-family: Times New Roman; font-size: small;">Saya yakin benak hati Datuk Chua Su Lek (MCA), KOh Tsu Koon (GERAKAN), YB Tony Pua (DAP) dan pimpinan Pakatan Rakyat lain berbanding agenda perkauman sempit Perkasa hanyalah satu, iatu Keadilan (Justice) untuk semua tanpa mengira batasan kaum, agama dan bangsa. Kita tidak lagi boleh melihat keadilan daripada kacamata satu bangsa sahaja. Yang lebih penting mereka yang menjadi mangsa ketidakadilan perlu dibela! </span></p>

<p class="MsoNormal" style="margin: 0cm 0cm 10pt; text-align: justify;"><span style="font-weight: normal; font-size: 11pt; line-height: 115%;"><span style="font-family: Arial;">Over the last 2 years, my colleagues and I have been on a concerted campaign to highlight the political persecution of Malaysia&#8217;s champion and advocate of freedom, democracy and justice, Mr Anwar Ibrahim, who is also Leader of the Opposition in our Parliament on charges of sodomy for the second time since the first charge (in 1998) was overturned by the courts in 2004. As a result of our efforts, there is increasing support from the Malaysian people that this humiliation and violation of a fellow citizen&#8217;s fundamental rights should be cease forthwith. It is a blemish on Malaysia&#8217;s international image.</span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 10pt; text-align: justify;"><span style="font-weight: normal; font-size: 11pt; line-height: 115%;"><span style="font-family: Arial;">The present case against Mr. Anwar which is before the courts should be dropped forthwith. This is because there is foundation in fact for this case to proceed at the expense of taxpayers&#8217; money and the conscience of the peace loving and decent Malaysians. Four accredited doctors including a panel of three doctors from a Malaysian government hospital concluded there was no sign of sexual assault on the accuser, Mr. Saiful Bukhari. The Malaysian government has persistently refused to heed the voices of its citizenry and, therefore, we have little choice but to take this tragic episode in our history before the international community.</span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 10pt; text-align: justify;"><span style="font-weight: normal; font-size: 11pt; line-height: 115%;"><span id="more-223"></span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 10pt; text-align: justify;"><span style="font-weight: normal; font-size: 11pt; line-height: 115%;"><span style="font-family: Arial;">We, therefore, urge you and your colleagues to endorse our call to the Malaysian Government for an end to the political persecution of Mr. Anwar Ibrahim. We are confident that with your support the Malaysian people will be further encouraged to persuade their representatives in our Parliament to do what is right in the name of justice to end oru Government&#8217;s political vendetta against our leader who has done so much in so short a time to promote fundamental human rights and democracy in Malaysia.</span></span></p>

<p>GEORGE TOWN: After two weeks of “no-show” at Pakatan Rakyat events which fuelled talk that he would quit the party, Balik Pulau MP Yusmadi Yusoff has emerged to say he is staying put.</p>
<p>“I have been down with fever and flu for over two weeks after returning from a Youth conference in Manila.</p>
<p>“I was too sick to attend most of the functions but I did show up in court to show my support for PKR adviser Datuk Seri Anwar Ibrahim.</p>
<p>“So talk of me jumping ship is a non-issue,” he said.</p>
<p>Yusmadi underwent a medical check-up at Hospital Universiti in Petaling Jaya yesterday.</p>
<p>“PKR president Datuk Seri Dr Wan Azizah Wan Ismail has also given me medical advice,” he said, adding that he still felt numbness on the right side of his head.</p>
<p>Speculation has been rife that more PKR elected representatives were planning to leave the party after Bayan Baru MP Datuk Seri Zahrain Mohd Hashim quit PKR last Friday.</p>

<p><span style="text-decoration: underline;">Balik Pulau MP Yusmadi Yusoff</span> said senior leaders should address this issue during the coalition&#8217;s inaugural national convention in Shah Alam tomorrow.</p>
<p>&#8220;Pakatan leaders should present themselves as pro-active, progressive and prepared to give young talents a chance to join in the political decision-making process, he said.</p>
<p>&#8220;Tomorrow&#8217;s convention is the ideal platform for the coalition to portray this.&#8221;</p>

<p>He said that young voters were the instruments of change in last year&#8217;s general election and it was only natural to embrace more young talent into Pakatan&#8217;s fold.</p>
<p>&#8220;Without young talents, Pakatan cannot possibly put up a youthful front. It is imperative to attract dynamic, talented and progressive minded leaders.</p>
<p>&#8220;Pakatan needs to show publicly that it is proactive in moving away from current conventional youth policy of Barisan Nasional, designed by Umno,&#8221; said Yusmadi.</p>
<p>He said the BN/Umno youth policy is only used to fish for votes and make them yes-men for senior leaders.</p>
<p>&#8220;Umno and BN <a href="http://blog.yusmadi.com/news/115197"><strong>patronage politics</strong></a> is more about the money men making decisions on the behalf of everybody.</p>
<p>&#8220;Pakatan shall not emulate it,&#8221; insisted Yusmadi, the PKR national youth exco in charge of international affairs.</p>
<p><span style="color: #800000;"><strong>Old school thinking must be discarded</strong></span></p>
<p>Pakatan must show that the coalition is prepared to depart from old school thinking and bring in fresh young talent to effect changes in the political landscape.</p>
<p>He said today&#8217;s youth were no longer keen to be bystanders and just be part of patronage politics espoused by Umno and BN.</p>
<p>He said they wanted to be part of the political decision-making process to decide the present and future direction of the country.</p>
<p>&#8220;Pakatan should also address <a href="http://blog.yusmadi.com/news/118499"><strong>decisively</strong></a> the grouses among minorities such as Indians, Sabah and Sarawak ethnic groups against the coalition,&#8221; said Yusmadi.</p>
<p>&#8220;They should unveil the coalition&#8217;s strategy to forge close ties with minority groups such as Hindraf and civil rights movements in Sabah and Sarawak, and <a href="http://blog.yusmadi.com/news/116827"><strong>labour organisations</strong></a>.&#8221;</p>
<p>&#8220;Addressing issues pertaining minority and workers&#8217; interests and rights is vital if Pakatan wants to be a hybrid organisation,&#8221; said Yusmadi, the former Penang youth chief.</p>

<p>Such a concept, says the young Balik Pulau parliamentarian, would expand Pakatan&#8217;s agenda and make it relevant to the people&#8217;s sentiments and aspirations.</p>
<p>&#8220;All politicians must comprehend the fact that political power was given by the people. The people are the real stake holders in political power. Therefore, it&#8217;s not wrong to include them into our political sphere,&#8221; he said.<br />

<strong>&#8216;Choose members wisely&#8217;</strong></span></p>
<p>However, he cautioned that Pakatan could not simply include just any non-political organisation into its fold without obtaining a consensus on a common agenda and political destiny.</p>
<p>He said the NGOs and civil rights groups should first agree with Pakatan&#8217;s struggle, reform drive and a common agenda to bring about political change for the betterment of the people.</p>
<p>The groups, said Yusmadi, should also agree to work hand-in-hand with Pakatan political allies to go to the ground, disseminate information and effect the desired change.</p>
<p>&#8220;Only then the objective of a hybrid coalition can yield the desired results,&#8221; he said.</p>
<p>According to Yusmadi, the current political scenario was not about political membership and one-upmanship games.</p>
<p>&#8220;People now demand results. They are not interested in politicking. They want the politicians to perform and deliver,&#8221; he said, adding that politicians would benefit enormously by having non-political grassroots leaders by their side.</p>
<p>He said NGO and civil rights leaders would represent the interests and aspirations of grassroots, providing valuable input for Pakatan to draw up plans and strategies to carry out people-orientated programmes.</p>
<p>In this aspect, he said a <a href="http://blog.yusmadi.com/news/116533"><strong>close cooperation</strong></a> with the Hindu Rights Action Force (Hindraf) and civil rights movements in Sabah and Sarawak was crucial and vital for Pakatan.</p>
<p>He said minority interests and rights should form part of Pakatan&#8217;s hybrid agenda.</p>
<p>A hybrid political and non-political coalition would be incomplete, Yusmadi explained, without direct and effective participation of these <a href="http://blog.yusmadi.com/news/118429"><strong>civil society groups</strong></a>.</p>
<p>He said it was time for politicians to shred their old way of thinking that political governance was only for politicians.</p>
<p>People, he said, now wanted to be part of the political governance and decision-making process. They were no longer interested in being just bystanders, to be guided by politicians.</p>
<p>He believes the people now want to self-determine their common destiny and that his idea, if realised, would help them do so.</p>
<p>&#8220;It would encourage the desired bottom-to-top political development, unlike the Barisan Nasional&#8217;s top-to-bottom political style,&#8221; he said.</p>

<h1>Kesas 11 acquitted of illegal assembly</h1>

<div id="story_content"><strong>AMPANG:</strong> After a nine-year wait, the day of liberation has finally arrived for 11 people who have been acquitted of illegal assembly at the Kesas Highway in 2000.</div>
<p>The 11 were also acquitted of another charge of refusing to disperse despite several notices during the incident which took place between 2pm and 7pm on Nov 5, 2000 between Km21 and Km 28.2 of the Kesas highway in the Klang district.</p>
<p>They had allegedly gathered illegally at Kesas Highway as they made their way to a ceramah in Jalan Kebun organised by the then Barisan Alternatif which was to be attended by Keadilan president Datin Seri Dr Wan Azizah Wan Ismail.</p>
<p>The 11 were part of the 125 who were initially detained for illegal assembly along the Kesas Highway, Bukit Kemuning and Jalan Kebun.</p>
<p>Police had also seized several weapons during the incident including parangs and wooden bats.</p>
<p>On Tuesday, Ampang Sessions Court judge Noradidah Ahmad acquitted the 11 of both charges although only 10 were present in court including a woman and a personal assistant to a Selangor exco member.</p>
<p>She said the defence had managed to raise reasonable doubt over the case.</p>
<p>Defence lawyer <span style="color: #ff0000;">Yusmadi Yusoff </span>said Mohamad Salim Laidin, a diabetic patient, could not be present in court as he was recovering from a feet surgery.</p>
<p>Mohamad Salim had had three toes removed.</p>
<p>There was initially a dilemma on whether the verdict should be read out or postponed to another day, given Mohamad Salim’s absence.</p>
<p>After a brief stand-down, Noradidah then gave her verdict that all 10 and Mohd Salim be acquitted of both charges.</p>
<p>The 10 rejoiced as they left the courtroom. Shouts of Hidup Rakyat were heared along the corridors. One of the 10, Mat Dan Hassan, welcomed the verdict with open arms, stating that it was long overdue.</p>
<p>“It was not an illegal gathering. We were trapped on the highway and had no way out,” he claimed.</p>
<p>S. Pospan Linggam said it had been a “very painful wait” for almost a decade.</p>
<p>“We have been going back and forth to court every year for the last nine years. I’m glad justice has finally been served.”</p>
<p>Abd Razak Ismail, who is now the special assistant to Selangor executive councillor Dr Xavier Jayakumar, thanked the court for upholding the principles of freedom and for acknowledging Suhakam’s inquiry.</p>
<p>In 2001, Suhakam released a report blaming the police for human rights violations during crowd dispersal and treatment of those arrested for taking part in the illegal assembly.</p>
<p>The report was criticised by certain quarters including then Prime Minister Datuk Seri Dr Mahathir Mohamad who said it was one-sided and influenced by Western thinking.</p>
<p>The inquiry was set up to look into allegations of police brutality during the incident.</p>

<p>Ingin saya jelaskan di sini bahawa saya <strong>tidak pernah sekali-kali membangkitkan isu jawatan KM <span style="text-decoration: underline;">DIGILIR</span> ikut formula baru</strong>. Saya memberi pandangan <strong>berlatar belakangkang sambutan hari raya</strong> yang antara lain menunjukkan bahawa terdapat penerimaan masyarakat terhadap <strong><span style="text-decoration: underline;">citra kepimpinan politik baru yang dibawa oleh Pakatan</span></strong> <span style="text-decoration: underline;"><strong>Rakyat</strong></span> selepas 8 Mac 2009. Kunjungan rakyat berbilang kaum ke rumah-rumah terbuka anjuran pimpinan Pakatan Rakyat tidak kira bangsa seperti yang dianjurkan oleh pimpinan PKR, DAP dan PAS menggambarkan bahawa formula kepimpinan yang digunakan oleh BN/UMNO yang mengangkat agenda perkauman telah ditolak. Saya cadangkan kenyataan saya dibaca <span style="text-decoration: underline;"><span style="color: #ff0000;">tanpa TAJUK</span></span> dan <span style="text-decoration: underline;"><span style="color: #ff0000;">Tafsiran</span></span> yang diberikan oleh akhbar, tetapi fokus kepada <span style="text-decoration: underline;">petikan (quotation)</span> yang digunakan yang lebih menggambarkan kenyataan saya yang sebenar. Antaranya, Parlimen Malaysia sekarang belum mampu membawa aspirasi &#8216;government of the people, by the people and for the people&#8217;. Maksud saya kekadang aspirasi dan suara rakyat tak dapat dibahaskan sewajarnya dek kerna kerterbatasan masa, budaya yg lama dan perlu perobahan, keterbatasan sumber dan masa, kekangan politik &#8216;zero sum&#8217; menang jadi arang kalah jadi abu, seniority, ketua whip, konvensi westminister, media berat sebelah, procedur ketat aturan mesyuarat, sikap culas kehadiran menteri dan wakil rakyat di dewan, sikap main-main, sikap kepartian yang sempit etc.</p>
<p>Saya merasakan perlu diwujudkan satu ruang yang lebih mengambarkan aspirasi demokrasi rakyat yang &#8216;terputus&#8217; disebabkan permasalahan di atas. Teknologi maklumat seperti Facebook memungkinkan segala permasalahan yang saya sebutkan dapat dikurangkan. Mari kita cuba ruang Parlimen Maya Malaysia.</p>
